From gender neutral offences to death penalty for gangrape: Govt bid to replace British-era laws

Home Minister Amit Shah introduced the Indian Judicial Code Bill, the Indian Civil Defense Code Bill and the Indian Evidence Bill in the Lok Sabha today. These three bills will replace the Indian Penal Code, the Criminal Procedure Act and the Indian Evidence Act.

Union Home Minister Amit Shah on Friday in the Lok Sabha, describing the IPC made in 1860, the CrPC made in 1898 and the Indian Evidence Act made in 1872 as a sign of slavery, three new bills – Indian Code of Justice Bill-2023, Indian Civil Defense Code Bill-2023 and Indian Evidence Bill 2023 were introduced. All the three bills have been sent to the Standing Committee on Shah’s request.

Presenting these three bills in the House, Amit Shah said that the purpose of the laws made by the British Parliament during the British period was to punish while the purpose of these three bills is to give justice. Claiming that these laws have brought a radical change in the Indian judicial system and the penal system, he said that these three bills have been brought after four years of intense deliberations.

Amit Shah said that the provision of sedition has been repealed in the Indian Judicial Code Bill and provision of maximum punishment has been made for crimes like mob lynching and rape of women and minors. In this, the punishment has been fixed against the perpetrators of sexual abuse by changing the name and there is also a provision for attachment of the property of the guilty, for the first time in the bill, a provision has been made to provide community service as a punishment for minor crimes. Along with this, a law has also been brought on election-related crimes, in which there is a provision of one year imprisonment for bribing voters in elections.

Stringent punishment for rape and gang rape of a minor

In the new bill, the minimum punishment in rape cases has been increased from 7 years to 10 years. In the case of rape of a minor, the punishment was increased to 20 years. Under the new law, a provision for death penalty has been made for gang rape of a minor. A new provision has been inserted in the rape law which defines that non-resistance does not mean consent. Apart from this, a provision has been made for punishment by keeping the person who has sex by false identity in the category of crime. A new law has been enacted to protect the identity of rape victims.

Law against sexual harassment of men abolished

In the new bill, section 377 of unnatural sex offenses has now been completely abolished. So there is no law now to protect men from sexual harassment. Under section 377 of IPC, whoever has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment of either description for life, or with imprisonment of either description for a term which may extend to 10 years, or with fine. But under the new law, there is no provision for punishment for unnatural sex offenses against men.

A new chapter on crimes against children has been included in the new bill. This includes abandonment, disposal of the child’s body and child trafficking etc. The punishment for death by negligence has been increased from 2 years to 7 years. Provision has been made for a new law against organized crime. If someone dies in this, then there will be a death sentence. The new law against terrorism has provision for death penalty.

The new bill defines sedition as an ‘act prejudicial to the unity, sovereignty and integrity of India’ and increases the minimum punishment for it from 3 years to 7 years. Explain that the new law has been brought in place of the sedition law, which includes secession, armed rebellion, separatist activities and subversive activities or acts threatening the sovereignty or unity and integrity of India. Under the new law, community service has been introduced as a new form of punishment in India.
