Social activist Teesta Setalvad and her husband Javed Anand have got a big relief from the Supreme Court in the case of irregularities in NGO funds. The Supreme Court directed Teesta Setalvad and her husband Javed Anand to cooperate with Gujarat Police in the case filed against them for alleged misappropriation of funds. A three-judge bench headed by Justice SK Kaul passed the order after Additional Solicitor General SV Raju said the two were not cooperating in the investigation.
A bench of Justices Sudhanshu Dhulia and PK Mishra, while disposing of Gujarat government’s plea challenging the grant of anticipatory bail in the case, said the chargesheet has not been filed yet. ASG believes there is a lack of cooperation. Be that as it may, the respondents will cooperate in the investigation as and when required.
The apex court also disposed of Setalvad’s plea seeking deletion of the observations made by the Gujarat High Court in its February 8, 2019 judgment while granting anticipatory bail. While making his anticipatory bail absolute, the bench said, it is wrong to say that any comment made at the bail stage can hardly have any impact on the hearing of the case. We don’t need to say anything more than this.
The case of alleged misappropriation of funds was registered by the Ahmedabad Crime Branch on a complaint, accusing Teesta Setalvad and Anand of “fraudulently” obtaining a grant of Rs 1.4 crore from the central government through their NGO Sabrang Trust between 2008 and 2013. The allegation was made.
