Advocate Rajeev Mohan, appearing for Brij Bhushan Sharan Singh, argued before Additional Chief Metropolitan Magistrate (ACMM) Harjit Singh Jaspal of Rouse Avenue Court that the alleged offenses under section 188 of the Code of Criminal Procedure (CrPC) were committed outside the country Hence the case cannot be tried by this Court. Magistrate can only take cognizance but cannot initiate trial.

The lawyer said that under the CrPC there is a time limit for taking cognizance of an offence. They have fixed time limits for framing charges. Therefore, it was argued that the police report does not offer any sufficient explanation and no general explanation can be accepted to condone the delay in FIR.
